Terms & Conditions – Borneo Glamping

TERMS AND CONDITIONS

The terms and conditions contained herein (“Terms and Conditions”) shall be applicable to all persons that have rented glamping spot(s) and/or glamping package(s) on the Borneo Glamping website (singularly referred to as “Registered Camper” and collectively as “Registered Campers”) and visitors of our event (singularly referred to as “Visitor” and collectively as “Visitors”).
Registered Campers shall be required to redeem their respective camper wristbands (“singularly referred to as “Camper Wristband” and collectively as “Camper Wristbands”) in order to gain access to the glamping zone. For clarity purposes, Camper Wristbands can be redeemed during check-in at the designated secretariat counter upon presentation of Identity Card (“I.C”) matching the name used for booking. Borneo Glamping reserves the right at its sole discretion to refuse entry of the Registered Camper in the event the name used for booking does not match the name on the I.C for safety and security purposes.
One (1) Registered Camper is only entitled to one (1) Camper Wristband. Registered Campers are fully responsible for their own Camper Wristbands and no Camper Wristband shall be re-issued in any circumstances including but not limited to lost or damaged Camper Wristband.
Camper Wristband must be worn at all times on both event days. Any Registered Camper found without his Camper Wristband shall be required to leave the glamping zone immediately without refunding the full payment and Deposit. No correspondence, appeals or complaints on such decision shall be entertained.
Visitors shall be required to redeem their respective visitor wristbands (“singularly referred to as “Visitor Wristband” and collectively as “Visitor Wristbands”) in order to gain access to the event ground except glamping zone. For the avoidance of doubt, redemption of Visitor Wristband is free of charge but Visitors shall be required to fill out the visitor registration form provided by Borneo Glamping. Borneo Glamping reserves the right at its sole discretion to refuse entry of the Visitor in the event the Visitor refuses to fill out the visitor registration form for safety and security purposes.
The glamping zone is strictly for Registered Campers with Camper Wristbands only. No Visitors nor Registered Campers without Camper Wristbands are allowed to enter the glamping zone.
The Registered Campers and Visitors shall be obliged to compensate or reimburse any damage to any furniture and fixtures of Borneo Glamping, its partners or vendors, amenities and facilities in the vicinity of the event ground and Aeon Mall Kuching, in whatsoever nature and arising as a result of the direct or indirect accidental, deliberate, negligent or reckless act of the Registered Campers and Visitors. Borneo Glamping, its partners, vendors, affiliates, related parties and Aeon Mall Kuching shall have the rights at their sole discretion to determine the adequate amount of compensation or reimbursement without assigning any reasons to the Registered Campers and Visitors.
Aeon Mall Kuching retains the full authority on collection of parking charges and management of its parking space. Borneo Glamping, its partners, vendors, affiliates and related parties shall not be held liable and responsible for any direct, indirect or consequential loss or damage in whatsoever nature or however arising as a result of Aeon Mall Kuching’s designated parking space and the collection of parking charges.
Borneo Glamping reserves the rights at its sole discretion and at any time, to amend, cancel and/or substitute the event schedule, activities and contests, any promotional vouchers and codes and contests’ prizes without prior notice and assigning any reasons to the Registered Campers and Visitors. The decision of Borneo Glamping in relation to every aspect of this event including but not limited to the promotional vouchers and codes, contests’ winners and prizes shall be deemed final and conclusive under any circumstances and no correspondence, queries and appeals shall be entertained.
Borneo Glamping reserves the rights at its sole discretion and at any time, to amend or cancel the event schedule, activities, contests and list of vendors without prior notice and assigning any reasons to the Registered Campers and Visitors.
Borneo Glamping reserves the right at its sole discretion to cancel or postpone this event without prior notice and assigning any reason to the Registered Campers and Visitors. For the avoidance of doubt, cancellation or postponement shall not entitle the Registered Campers and Visitors to any claim or compensation against Borneo Glamping for any loss or damage suffered or incurred as a direct or indirect result of the cancellation and termination.
Borneo Glamping shall not be held liable and responsible for any failure or delay in performing its obligations, cancellation or postponement of this event due to circumstances not within its reasonable control. Such circumstances shall include but not limited to, supervening events, weather conditions, fire, flood, strike, hostilities, political unrest, riots, epidemic and pandemic as pronounced by the World Health Organisation, inevitable accidents, supervening legislation or any other circumstances of whatsoever nature beyond the control of Borneo Glamping.
Borneo Glamping, its partners, vendors, affiliates and related parties shall not be held liable and responsible for any direct, indirect, special or consequential loss or damage or loss of profits, expense, liability, disappointment, personal injury, or death which is incurred, suffered or sustained, whether or not arising from any person’s negligence, by the Registered Campers and Visitors in connection with this event, the activities and contests of this event, or the use of any promotional vouchers and codes and contests’ prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
The Registered Campers and Visitors agree to hold harmless, defend and fully indemnify Borneo Glamping from and against all losses including but not limited to loss of opportunity and consequential loss arising therewith, direct, indirect, special or consequential damages, expenses and all third party actions, proceedings, claims, demands, personal injuries, death, loss or destruction of property, rights of publicity or privacy, defamation that may arise as a result of this event.
By participating in this event, the Registered Campers and Visitors shall be deemed to have acknowledged and consented to the collection, processing, storage and use of personal information by Borneo Glamping. For clarity purposes, the Registered Campers and Visitors may be contacted at any time and via any mode of communication deemed appropriate by Borneo Glamping.

Specific Terms and Conditions

The specific terms and conditions contained herein (“Specific Terms and Conditions”) are established to ensure the security, safety and comfort of all Registered Campers. That being so, these Specific Terms and Conditions shall only be applicable to Registered Campers.
Full payment including a refundable deposit (“Deposit”) must be made upon booking to secure a glamping spot and/or glamping package.
By making full payment, Registered Campers shall be deemed to have agreed that Borneo Glamping has the sole discretion on allocation of glamping spot(s). No correspondence, queries, appeals on the allocation of glamping spot(s) or cancellation shall be entertained.
The confirmation notification from Borneo Glamping shall be the official and final proof of successful booking. Borneo Glamping reserves the right at its sole discretion to verify the validity of the transaction. Without limitation, the Registered Campers agree to provide full cooperation and the required information to Borneo Glamping for such purposes.
Borneo Glamping shall not be held liable or responsible for corrupted transaction, failure to make booking or complete payment due to issues arising from internet connection, banks or e-wallet providers.
Registered Campers are strictly not allowed to cancel their bookings. For the avoidance of doubt, full payment and Deposit shall be forfeited in the event of no-show.
Registered Campers shall be allowed to transfer ownership of the glamping spot and/or glamping package by providing three (3) days prior written notice to borneoglamping.my@gmail.com and obtaining the written consent of Borneo Glamping.
One (1) parking lot shall be assigned to the Registered Campers next to their respective glamping spot(s). For clarity purposes, Registered Campers with more than one (1) vehicles can park their vehicle(s) at Aeon Mall Kuching’s designated parking space.
Registered Campers shall be responsible for the full payment of parking charges including that charged on the assigned parking lot. For clarity purposes, the parking rate at Aeon Mall Kuching is free for the first four (4) hours but an hourly rate of Ringgit Malaysia one (RM1) or a flat rate of Ringgit Malaysia four (RM4) for overnight parking shall be chargeable.
Registered Campers shall ensure to keep noises to minimal between 12am to 8am the next day. Borneo Glamping shall have the rights in its sole discretion to request any Registered Campers that cause commotion, excessive noise and unreasonable disturbance to other Registered Campers to leave the glamping zone immediately without refunding the full payment and Deposit. No correspondence, appeals or complaints on such decision shall be entertained.
Registered Campers below the age of 12 years old must be accompanied and taken care of by an adult Registered Campers at all times throughout the event period.
Registered Campers shall ensure to zip their respective tent and bring along their personal belongings when leaving the glamping zone. Registered Campers are fully responsible for their personal belongings. Borneo Glamping, its partners, vendors, affiliates, related parties and Aeon Mall Kuching shall not be held liable and responsible for any theft, loss and damage occurred during the event period.
Registered Campers shall be obliged to bring their own garbage bags for disposal of general and food waste. Used garbage bags must be properly tied and disposed into the rubbish bin provided at the glamping zone. Failure of the Registered Campers to ensure the cleanliness of the glamping zone shall result in forfeiture of Deposit.
Registered Campers shall only be allowed to set up tents, arrange camping equipment and utilise the area within the markings on the assigned glamping spot. Utilising the area outside the assigned glamping spot shall entitle Borneo Glamping the absolute right to impose additional charges and/or forfeit the Deposit and/or request the Registered Campers to remove the items immediately.
Registered Campers are strictly prohibited to bring pets to the glamping zone.
Registered Campers are strictly prohibited from smoking and vaping inside the tent.
Registered Campers are strictly prohibited to bring goods and/or store any equipment of a combustible or hazardous nature and/or prohibited goods and/or goods of objectionable nature to the glamping zone unless with the written consent of Borneo Glamping two (2) days prior to the commencement of the event.
Registered Campers shall be obliged to instantly inform Borneo Glamping of any emergency event(s) including but not limited to fire and injury. Be that as it may, Clause 14 and 15 apply strictly.
Deposit shall be refunded to the Registered Campers within forty-eight (48) hours after the event ends, via DuitNow or online banking transfer, subject to Borneo Glamping receiving all information deemed necessary. Borneo Glamping shall have the rights at its sole discretion to determine the method for refunding the Deposit without prior notice or assigning any reasons to the Registered Campers.
With reference to Clause 34, Registered Campers shall be deemed to have acknowledged and consented to the collection, processing, storage and use of personal information and bank details for the purpose of facilitating and processing the Deposit.
Notwithstanding Clause 34, Borneo Glamping shall have the rights at its sole discretion to forfeit in full or partial the Deposit for non-adherence to the Terms and Conditions including these Specific Terms and Conditions loss or damage in whatsoever nature caused by the direct or indirect accidental, deliberate, negligent or reckless act of the Registered Campers.

Registered Campers that rent glamping package(s):

By making full payment for rental of the glamping package, Registered Campers shall be deemed to have understood and consented that photos of the items in the glamping packages are solely for illustration purposes. Borneo Glamping shall have the rights in its sole discretion to substitute any items and/or vary the brand and/or colour of the item(s) without changing the size and compromising the quality of the item(s).
Registered Campers are strictly prohibited to re-arrange or move the furniture, fixtures and any items from their set position or use them in a manner other than that for which they were designed unless with the written consent of Borneo Glamping.
Registered Campers are obliged to return all furniture, fixtures and items in the same quantities as per the items checklist provided by Borneo Glamping upon check-in and in the conditions as they were during handover. In cases of lost, soiled or damaged in whatsoever nature and arising as a result of the direct or indirect accidental, deliberate, negligent or reckless act of the Registered Campers, the Deposit shall be forfeited and the Registered Campers shall be obliged to compensate for the lost or reimburse the cost of rectifying the damage or soiling based on Borneo Glamping’s lost and damaged items’ price list. Borneo Glamping shall have the rights in its sole discretion to determine the adequate amount of compensation or reimbursement without assigning any reasons to the Registered Campers.
Borneo Glamping reserves the right at its sole discretion to amend, delete and/or substitute any of these Terms and Conditions, including the Specific Terms and Conditions, from time to time, without any prior notice and assigning any reasons to the Registered Campers and Visitors. Such revised terms and conditions shall be posted on the Borneo Glamping’s website and effective immediately upon posting.
These Terms and Conditions, including the Specific Terms and Conditions, shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional or advertising materials for this event.
These Terms and Conditions, including the Specific Terms and Conditions, may be translated to other languages. In the event of inconsistency between this version and translated version, this version shall prevail.
These Terms and Conditions, including the Specific Terms and Conditions, are governed by the laws of Malaysia and subjected to the jurisdiction of a forum in Malaysia.
In the event of any dispute arising out of or in connection with these Terms and Conditions, including the Specific Terms and Conditions and/or this event, Borneo Glamping, the Registered Campers, Visitors and all relevant parties directly affected by and involved in the dispute shall make a minimum of two (2) attempts to negotiate in good faith and resolve the dispute amicably. In the event of failure to attain a resolution through good faith negotiation, the dispute shall be referred to and finally resolved by arbitration.
